Waiver of Liability I hereby agree to participate in the 5k run training program (Sun Country Beginner's 5K Training Program) organized by [Sun Country Cycling], beginning on [6/12/23]. In consideration of being allowed to participate in the Program, I hereby agree to the following: I hereby acknowledge that the Program involves physical activity, which could be strenuous and may involve risks of physical injury. I am aware that participating in the Program may result in injury, death, or property damage. I hereby agree to assume the risks associated with the Program. I hereby release and forever discharge [Sun Country Cycling] and its employees, agents, representatives, successors, and assigns from any and all claims, causes of action, suits, debts, dues, sums of money, accounts, reckonings, covenants, contracts, controversies, agreements, promises, variances, trespasses, damages, judgments, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, that I, my heirs, executors, administrators, assigns, or representatives may have against [Sun Country Cycling] or its employees, agents, representatives, successors, and assigns, arising out of or in any way related to the Program. I hereby agree to indemnify and hold harmless [Sun Country Cycling] and its employees, agents, representatives, successors, and assigns from any and all liabilities, damages, and costs, including, but not limited to, legal fees, that they may incur arising out of or in any way connected with my participation in the Program. I hereby represent that I am in good physical condition and am able to participate in the Program. I hereby agree to abide by all instructions, warnings, and rules given by [Sun Country Cycling] or its employees, agents, representatives, successors, and assigns. I hereby acknowledge that the Program is not a substitute for medical advice or treatment. I hereby certify that I have consulted a physician prior to participating in the Program and that I am aware of my own medical condition. I hereby agree that any dispute arising out of or relating to this agreement shall be governed by the laws of [Texas]. I have read and understand this document. I understand that by signing it, I am giving up certain rights, including the right to sue, and I accept it voluntarily.
