Please read this waiver carefully. It includes releases of liability and waiver of legal rights and deprive you of the ability to sue Runologie, LLC. Do not agree to these documents unless you have read and understood it in its entirety. By signing, you acknowledge that you have both read and understood all text presented to you as part of the registration process. You also understand and agree that events carry certain inherent dangers and risks, which may or may not be readily foreseeable, including without limitation personal injury, property damage or death. Your ability to participate in this event is subject to your agreement to the waiver and by agreeing herein, you accept and agree to the terms of the waiver and release agreement. Assumption of Risk, Release, and Indemnity Agreement Assumption of Risk: I understand that the activities in which I will engage at or near Runologie’s Store site at 401B Hillsborough Street, Raleigh, NC 27603, involve inherent and other risks. This location includes all running routes within the Downtown Raleigh area as included on a separate “Raleigh Ale Trail” document made available to all participants. I acknowledge that the activities are strenuous and dangerous and require a certain degree of physical condition, ability, maturity, and skill including the requirement that each participant MUST be over age 21, the legal drinking age. I acknowledge that I am solely responsible for determining my suitability to participate in the activities. I have the requisite skills, qualifications, physical and mental ability, and training necessary to properly and safely participate in the activities. I share responsibility for my safety and will follow instructions, make reasonable decisions, and act responsibly. The Owners, Manager, and Staff of Runologie LLC cannot ensure my safety and do not seek to eliminate all of the risks of the activities before each group run. I choose to voluntarily participate and observe the activities despite all risks. I assume all inherent and other risks and accept responsibility for any property damage and loss, and for any personal injury, illness, disability, emotional distress, and death that I may suffer, whether described above or not. In consideration of Runologie LLC providing services and facilities and allowing me to participate in or observe the activities, I agree to the following: Waiver and Release: I, agree to forever release and discharge Runologie LLC from and agree not to sue for any and all liability or claims I may have for any property damage and loss, personal injury, emotional distress, illness, disability, and death, related to my (or my child’s) participation in the activities. This release is for any type of claim, including breach of contract, fraud, or any other type of suit and includes personal injury and property losses alleged to be caused by the negligence of Runologie LLC to the fullest extent permitted by law but does not include claims for gross negligence. Indemnity: I agree to defend, indemnify (meaning to pay or reimburse any amount required to be paid, including attorneys fees) and hold Runologie LLC harmless from all claims, causes of action, liability, losses, or damages for any property damage, property loss or theft, personal injury, disability, death or other loss brought by or on behalf of me, a family member, my estate, another participant or spectator, or any other person arising from or relating to my participation in the activities, including claims that Runologie LLC was negligent. Additional Provisions: I agree that the substantive laws of North Carolina govern this Agreement and any dispute I have with Runologie LLC and consent to jurisdiction in North Carolina. Any mediation, suit, or proceeding will be entered into only in North Carolina. Any portion of this Agreement deemed unlawful or unenforceable is severable and shall be stricken without effect on the enforceability of the remaining provisions. I have read this agreement, I understand its contents and I sign it voluntarily. I intend by this agreement to assume all hazards and risks, waive all rights to sue and release all liabilities and claims, and indemnify Runologie LLC for any claims arising from my (or my child’s) participation in the activities. I understand that this agreement will expire on November 18th at 8:30pm, but remains in effect at all times that I am (or my child is) observing or participating in the activities and activities thereafter and will be binding on me, my family members, my heirs, assigns, executors, representatives, and estate. The event will conclude by 8:30pm, but events that are a foreseeable result from the participation in the event will also be deemed to have been assumed by signing this agreement, including those arising after 8:30pm. I agree: I have carefully read, understand and agree to voluntarily sign this form by checking the box and completing the information below, and understand that by doing so I am entering into a legally binding contract with Runologie LLC. I acknowledge that this form shall be effective and legally binding upon me. You must be over 18 years of age in order to agree to the text above AND in order to participate in this event.
